This Terms of Service refers to the travel consulting service offered by Off The Track Japan.
1. Introduction
Welcome to Off The Track Japan Travel Consulting (“OTTJ”, “we”, “our”, or “us”). By purchasing or using our travel consulting services, you agree to the following Terms of Service.
OTTJ provides travel advice, itinerary planning, and destination guidance related primarily to travel in Japan. We do not act as a travel agent and do not directly sell flights, accommodation, tours, or other travel products.
By using our services, you acknowledge that OTTJ provides recommendations and guidance only.
2. Scope of Services
Our consulting services may include:
- Custom travel itineraries
- Destination advice
- Accommodation recommendations
- Transport suggestions (trains, flights, buses, etc.)
- Activity and sightseeing recommendations
- General travel advice for Japan
The exact scope of services will depend on the consulting package purchased or requested. OTTJ does not guarantee availability, pricing, or suitability of any recommended travel products.
3. No Booking Service
OTTJ does not directly book travel on behalf of clients unless explicitly agreed in writing, and paid in full with a 2.5% non-refundable commission.
Any bookings for:
- flights
- accommodation
- transport
- tours
- activities
must be completed by the client through third-party providers, unless there is no financial element. OTTJ may provide affiliate links or suggestions for booking platforms. These are provided for convenience only. For any bookings we make on behalf of a client, a booking agreement will be distributed prior to the booking. This must be signed and returned to Off The Track Japan representatives. This document may be used in defence of any false chargeback claims.
4. Affiliate Relationships
OTTJ participates in affiliate programs with various travel booking platforms. This means we may earn a commission if you book through links we recommend. This does not affect the price you pay.
Any updates, cancellations, dates changes must go through the final booking platform. It is up to the client to make any and all changes once the booking has been made.
5. Client Responsibilities
Clients are responsible for:
- verifying all travel details before booking
- ensuring passport validity
- obtaining visas if required
- purchasing travel insurance
- confirming accommodation and transport details
- reviewing cancellation policies of any third-party bookings
Travel conditions and requirements may change. Clients must verify current information with official sources.
6. Travel Risks
Travel involves inherent risks, including but not limited to:
- transportation delays
- natural disasters
- weather events
- political or regulatory changes
- illness or injury
OTTJ is not responsible for disruptions or losses caused by such events.
7. Accuracy of Information
OTTJ strives to provide accurate and up-to-date information. However:
- prices
- operating hours
- transport schedules
- availability
may change without notice.
We cannot guarantee that all recommendations will remain accurate at the time of travel.
8. Payment
Payment is required before consulting services are delivered unless otherwise agreed. All prices are listed in the currency specified at checkout.
9. Refund Policy
Due to the nature of consulting services, refunds are generally not offered once work has begun. Refunds may be considered in limited circumstances at the sole discretion of OTTJ.
10. Intellectual Property
All travel plans, itineraries, guides, and written material provided by OTTJ remain the intellectual property of Off The Track Japan. Off The Track Japan holds all the necessary rights for any images and media used.
These materials are provided for personal use only and may not be:
- resold
- redistributed
- reproduced for commercial purposes
without written permission.
11. Changes to services
OTTJ reserves the right to modify or discontinue consulting services at any time. Existing confirmed bookings will still be honoured.
12. Limitation of Liability
To the maximum extent permitted by law, OTTJ will not be liable for any:
- travel disruptions
- financial losses
- missed bookings
- changes in travel services
- personal injury or illness
arising from travel plans or third-party services. Our liability is limited to the amount paid for the consulting service.
13. Governing Law
OTTJ operates internationally, under Miruzu Travel Group. These Terms of Service are governed by the laws of New Zealand. Any disputes arising from these terms will be handled within the jurisdiction of New Zealand.
